Deed Book 38

[Deed Book 38, pgs. 47-48]  This deed made this 6th day of October 1885 between Thomas WHITEHALL & Sarah his Wife of the first part and Charles W. OWENS of the second part.  Witnesseth: whereas Sarah SANDERS afterwards Sarah O’NEAL Mother of the said Sarah WHITEHALL sold the land hereinafter conveyed before she became of lawful age & received a fair compensation for the same, and whereas we do not wish said land to be twice paid for; now therefore we the said Thomas WHITEHALL & Sarah his Wife in consideration of the premises and the sum of One Dollar to us in hand paid by said Charles W. OWENS the receipt of which we do hereby acknowledge have bargained sold & conveyed & by these presents do bargain sell convey & confirm unto the said Charles W. OWENS of the second part his heirs & assigns forever all our right title & interest in & to a certain tract or piece of land situate & being in Poplar Branch Township in said County and State bounded as follows, to wit: On the North & South by the lands of the said Charles W. OWENS on the East by O’Neals Creek & on the West by the main road containing Fifteen acres more or less, it being the land heired by said Sarah SANDERS by the death of her Brother Lemuel SANDERS to have & to hold said land & premises with all the tenements improvements privileges & appurtenances thereunto belonging or in any wise appertaining to him the said Charles W. OWENS his heirs & assigns to his & their own behoof & proper use, in fee simple forever & the said Thomas WHITEHALL & Sarah his Wife,  their heirs executors & administrators shall & will warrant & forever defend the title to said land & premises free & clear from the lawful claim or claims of any and of all persons whatsoever. In testimony whereof the said parties of the first part have hereunto set their hands & affixed their seals the day & date above written.  /s/ Thomas WHITEHALL, Sarah [x] WHITEHALL
