Last Will & Testament of Nathan King - 1829

In the name of God Amen
I Nathan King, Snr. of the County of Cumberland and state of North Carolina 
being in perfect mind and memory blessed be God for the same, but calling to 
mind the uncertainty of human life and knowing that it is appointed for all 
men once to die, do this nineteenth day of August in the year of our Lord one 
thousand eight hundred and twenty nine make and publish this my last will 
and testament in manners and form following (viz) ~~~~~~~~~~~~~

Firstly     I commend my body to the earth from whence it came, to be 
intered in a Christian like manner. As to my worldly estate with which it 
has pleased God to bless me with I dispose thereof as follows ~~~~~~~~~~~~~~~~~~~~~~~~

Secondly     I give devise and bequeath unto my son Michael D. King Three 
tracts of land containing seven hundred & twenty three acres joining his own 
four hundred acre tract on Carvers Creek to him and his heirs forever ~~~~~~
I have previous to making this my last will and testament given to my said 
son Michael D. King all of this property which I intended for him ~~~~~~

Thirdly		I give devise and bequeth to the heirs of Nathan King, Junr. one 
hundred & fifty-two acres of land where on he now lives also two negroes (viz) 
Sam and Winiford one bed and furniture two cows and calves to his heirs forever ~~~~~~~

Fourthly     I give devise and bequeth unto my son William M. King one 
negroe man (viz) Sam which he carried to Allabamma also one bed and 
furniture one mare and cart & two rifle guns which he also carried to 
Allabamma to him and his heirs forever ~~~~~~~~~~~~~~~~

Fifthly     I give devise and bequeth unto my daughter Flora Ann McKethan an 
half acre lot in Fayetteville joining Tellinghast and opposite Mrs. 
Winslow(?) also four negroes (viz) Nancy and her three children Annet Allen 
& Silvy one bed and furniture one set silver table spoons & two cows and 
calves to her and her heirs forever ~~~~

Sixthly     I give devise and bequeth  unto my son George T. King two 
hundred and thirty-one acres of land near the mouth of Carvers Creek it 
being a part of the Carvers Survey - one other tract containing one hundred 
& eighty acres it joining the above also three negroes (viz) George Loranzy 
& Betsy one bed & furniture and two cows and calves to him and his heirs 
forever ~~~~

Seventhly     I give devise and bequeth unto my son Henry R. King one tract 
of land containing one hundred acres more or less including my dwelling 
house and other improvements, one other tract of land containing ninety 
acres joining the lower line of the above tract, also three negroes (viz) 
April, old Leah and Mary one bed and furniture one walnut sideboard desk and 
table one set winzor chairs, two large looking glasses one set blacksmith 
tools, two cows and calves to him and his heirs forever ~~~~~~~~~~~~~~~~~~~

Eighthly     It is further my will desire and direction if my said son Henry 
R. King should die without leaving lawful heirs of his boddy then and in 
that case it is my will and direction that the property that I have 
bequethed to him in this my last will and testament to go to my next three 
youngest children (viz) Flora Ann McKethan, George T. King & Julia C. King 
and to be equaly divided amoung them their heirs forever ~~~~~~

Ninethly     I give devise and bequeth unto my daughter Julia C. King one 
tract of land containing one hundred and fifty acres known by the name of 
the gum survey one other tract of land containing two hundred acres joining 
the above called the Shaw tract also three negroes (viz) Esther Patsy & 
young Leah also the child that old Leah is now pregnant with one bed and 
furniture, one walnut beauro, two cows and calves one sow and pigs to her 
and her heirs forever ~~~~~~~

Tenthly     I give devise and bequeth unto my grand son Nathan King son of 
Michael D. King one tract of land containing two hundred acres joining 
Malcom J. Buies land called the Frenchman tract also one sow and pigs to him 
and his heirs forever. 

Eleventhly     It is further my will desire and direction that every species of 
property which I have or which I may be in possesion of at my death and not mentioned 
in my last will and testament to be sold or so much there of as may be required to 
discharge all my just debts to be discretionary with my executors to sell it wither at 
public or private sale to the best advantage ~~~~~~~~~~~

Twelvthly     It is futher my will desire and direction that the residue of 
my estate after the full payment of all my just debts, to be equally divided 
amoung my five children (viz) Nathan King, Jnr. Flora Ann McKethan, George 
T. King, Henry R. King and Julia C. King them and their heirs forever

Lastly      I hereby nominate constitute and appoint my son in law James 
McKethan and my son George T. King my executors to this my last will and 
testament In witness thereof I have hereunto set my hand and seal the day and date 
above writen ~~~~~~  Signed Nathan King

Signed sealed published and declared by the testator in our presence who at 
his request and in his presence and in the presence of each other have 
subscribed our names as witnesses
