Will of Abraham Misenheimer presented July Session 1811

In the name of God amen, I Abraham Misenhimer of the County of Cabarrus and state of North Carolina being sic and weakly in body but of a perfect mind and memmory thanks be to God for it and calling to mind the mortality of my body and knowing that it is for all men ones to die do make constitute and ordain this my Last Will and Testament , that is to say principally and first of all I will that all my lawfull debt and funeral charges shall be paid before eny devide is made of my estate.
1st- I give and beqeath unto my beloved wife Margereth my two plantation the one I now live on and the other wich I bought of Moncord , to enjoy and occupy as long till my youngest son Paul is of age and no longer ~
2ndly- I give unto my wife the priveledge to choice so many articals of house hold furniture and plantation tools as shee my thinck necessary for here house giving and here childern
3rdly- I give and beqeath unto my oldest sons Tobias and Elias Misenhimer, the plantation where my son Tobias now lives on , each of them an equill shear of said plantation to be devidet in two equill parts - and that to the best advantage of boath ef the can agree among than selves , and if the cant agree among them selfs then it shall be left to men wich the shall choice them selves.
4thly- I give unto Tobias Misenhimer of the above said plantation the shear or part he now lifes on and Elias Misenhimer shall have the wood part - and my son Tobias Misenhimer shall pay out of his shear one hundred dollars Lawfull money to the use of my estate after my decease.
5thly- I give and beqeath unto my son Moses Misenhimer the plantation wich I bouth of Morcord with the small ------ I made as an attition to the said plantation.
6thly- I give and beqeath unto my son Paul Misenhimer the plantation I now live on.
7thly- I give and beqeath unto my four daughters Margereth marrit to Daniel Slough and Christina - Easter- Sussanna Misenhimer shall have the two lots on twon of Concord. Each of tham having a equill shear and my executors shall sell these lots to the best advandadge the can either by privit or publick sale , and the money so arising shall be devedit equily among my four dathers than that is under age shall not draugh their shear till the ar of the agh of twenty one year except the marry under the age of twenty one then the shall be intitlet to ~
8thly- I give and beqeath unto my wife Margereth one hourse , a sadle and bridel one bed and bedstedd , spinning wheel , two iron pots one smal one and one mittle sighs - two pewter dishes , six pewter plates, one ------ spoons, two chears - two cows these articals my wife Margert Misenhimer shall haves if she marris again then the personal property of my estate remaining shall be sold by a publick sale and the money so arising thereof shall be devidet amongst my wife and four daughters my wife shall draugh two shears and each of my daughters ownly one shear. Ef my wife Margareth should not marry but remaining w widdow till my son Paul will arive to the age of twenty one then the remaining property shall be sold by my executors and thee money so rising shall be devided in the same manner as in this article above mentionet.
9thly- I give unto my three sons Elias, Moses and Paul Misenhimer each of tham a good hours after the arive to the age of twenty one year on this condition ef the works faithfull for her mother till the ar twenty one year old. And whoever don't worke faithfully till that time shall have no horse and no other recompence for said horse-
10thly- it is my will that ef any of my children should happen to die under age then his shear shall be equally devided among the remainder of my children ef a boy the land to be sold and likewise eaqually devided amongst the revivers-
11thly- it is my will that my youngest son Paul Misenhimer after he arives to the of twenty one years than he shall take this plantation in perfecton --- where I now life on and take the care of his mother -Fers he shall give her ten bushel of wheat-and fifteen bushel of corn , ten pound suger , four pound coffee, salt as much as she will wont for her use - my son Paul shall give a horse greader for his mother for her use at eney time allthough he shall have the use of the horse ef she don't wont him - allso two cows to feet than as his own all thouse articals is to be delivered every year without delay.
12- It is my will that my wife shall have the privaledge to choose sech articals of house furniture such as she may wont for here self wen she must quitt hause giving and before the sale~
Atition to the 11th article it is further my will that my son Paul Misenhimer shall furnish his mother at all times with a quantity of fier wood and bild a good fier if required and take here grain to mill as she shall wont it and here chois of the two houses to life in and to give it in good prepare at all times and further furnish his mother with a good fat hoge that will whigh about one hundred pount and fourty pound of good and fat beef this to be delivered every year and my son Paul shall give his mother free privelidge in the house she will chois to live in - he shall nither stope her going ner comming but let his mother live in peace at all times.
13thly- It is my will that after my decease when the first ------- shall happen wich will I suspose will settle all my debts with the out standing money- but ef eney overflush should happen then that over flush shall be devidid in the same maner of the 8th article between my wife and daughters.
14thly- & I do hereby constitute and apoint Tobia Misenhimer and Daniel Shloug(h) executors of this my Last will and Testament and I do hereby revoak disanull and make void all other will and ratifying and confirming this and no other to be this my Last will and Testament . In witness whereof I have hereunto set my hand and afixed my seal this 8th day of June in the year of our Lord one thousand Eight Hundred and a eleven. 1811~
