LAST WILL AND TESTAMENT OF JACOB SIMMONDS

In the name of God Amen, twentie fourth day of February in the year of our Lord 1735/6.

I Jacob Simmonds of Shallotte in New Hanover Precinct in North Carolina Planter being very sick and weak in body but of Perfect Mind and memory thanks be given to God therefore calling into mind the mortality of my body knowing it is appointed for all men once to dye do make and ordain this my Last Will and testament that is to say Principally and first of all I give and recommend my soul to God that gave it and my body to the Earth to be buried at the discretion of my Executors and as touching such worldly estate wherewith it hath pleased God to bless me in this Life. I give and dispose of the same in form and manner following.

In Primis. I give to my son John Simmonds two hundred and fifty acres of land lieng and being near Little River Butting upon the Sound allso I give to him one Large Chest and one large iron pot and one small iron Pot and a potrack & spit.

Item. I give to Jacob Simmonds my youngest son two hundred & fifty acres of land lieng in the fork of Shallotte and also one young mair and her increase also one featherbed and furniture & two iron Pots and the Pewter allso one Red Kow & calf & their increase.

Item. I give to my daughter Mary thirty Pounds North Carolina Currency.

Item. I give to my well-beloved wife Mary Simmonds whom I likewise constitute, make and ordain my sole Executrix of this my last will and testament all and singular the remainder of my lands goods and chattels to be Possessed and Enjoyed during her life the Legicies not to be Commanded from her before her deceas and then the Plantation whereon I now dwell I do ordain to be inherited by my youngest son Jacob Simmonds to be possessed and enjoyed by him & his heirs forever & I do constitute & appoint my trusty & well beloved friend Jonathan Swain of Lockwoodsfolly trustee & assistant to my son Jacob in his minority & I do hereby Revoke & disallow all other Wills ratifieng & confirming this & no other to be my last will & Testament.

His Excellency Gabriel Johnston, Esqr. His Majts. Govr. In Chief of North Carolina Before Me Appeared Jehosaphat Hallands one the the Witnesses to the Within Last Will & Testament of Jacob Symonds who being duly Sworn Says that He was present and saw the said Will signed Sealed and Published and that the said Symons was then in Sound and disposing Mind and Memory to the best of the Depts. Memory and belief.
Given at Newtown and my Hand 16 June 1736.

Before me appeared Mary Symons Widow Executrix to the Deceased and took the oath of Executrix according to Law.
