This indenture made the seventh day of September AD One Thousand Eight Hundred and One between Benjamin Rowell of the County and State aforesaid of the first part and Mary Godfrey Spencer of the same County and State of the second party and William Hall & Thomas Hooper and also of the County and State aforesaid of the third part witnesseth:
Whereas a marriage is shortly intended to be had and solemnized between the said Benjamin and the said Mary and the said Mary being possessed in her own right of a certain negro boy named Isaac and sundry head of cattle to wit: cows calves and some household furniture with monies at interest and sundry other property and it being the intention of the parties to secure to the Mary the use title to interest both in law and equity of in and to the said property and monies at interest after the said marriage had and solemnized now this indenture witnesseth that the said Benjamin and the said Mary for and in consideration of the said marriage and for the further consideration of ten pounds to them in hand paid by the said William and Thomas at or before the ensealing and delivery of this indenture the receipt whereof they do acknowledge they the said Mary and Benjamine have granted bargained conveyed and confirmed and do hereby grant bargain convey and confirm unto them the said William and Thomas executors & administrators of the said negro boy Isaac and sundry head of cattle to wit: cows & calves and household furniture with monies at interest and all and singular any property of what kind soever that she the said Mary may entitled to either in law or equity to have and to hold the same agreeably to the intent and meaning aforesaid - that is to say to the sole use benefit & behoof of her the said Mary for & during the said (?) and if the said Mary should survive and over live the said Benjamin then to the sole use benefit and behoof of the said Mary her heirs and assigns forever provided nevertheless if the said Benjamin should survive and over live the said Mary then and in such case the same to be held to the sole use benefit & behoof of him the said Benjamin his heirs and assigns forever and the said Benjamin doth covenant & agree to & with the said Mary and the said William & Thomas that he will abide by and perform all and singular the covenants by him hereby made and entered into according to true intent and meaning of the same and the said William & Thomas doth covenant and agree to & with the said Benjamin to the said Mary that he will hold the property herein to have conveyed according to the true meaning and intent of this indenture. In witness whereof the parties to these presents have hereunto set their hands and seals the day and year above written. Signed sealed and delivered in presence of us - the words and the said Mary between the seventh and eighth line in the first page from the top and the word the between the third and fourth line in the second page from the bottom of the fourth and fifth line & Thomas H Hooper interlined between the twenty first and twenty second lines interlined previously (?)
